Revium Standard Caveats

  1. If additional requirements not covered in your Proposal or Statement of Work, are uncovered because of further consultation, Revium reserves the right to amend costs accordingly.

  2. Where a task is charged on a time and material basis to a stated maximum number of hours, Revium will only invoice for the actual time spent. If during the course of this work it is discovered that further time (over the approved maximum) to complete the task is required - due to new client requests, previously unknown requirements, additional complexity or a change of scope - Revium will advise the client and discuss, in advance, the amount of additional time required or compromises that may need to be made to complete the agreed deliverable.

  3. Revium recommends all clients allocate a Contingency Budget for unexpected technical or functional requirements that come up during a project (particularly in the CX, Discovery, Requirements Gathering or Specification phases). The allocated Contingency Budget is for unforeseen needs or complexity not uncovered when constructing a Statement of Work or detailed Work Breakdown. Use of the Contingency Budget is for items not explicitly mentioned in a Statement of work or Work Breakdown and can only be used by Revium providing written advice in advance of the Contingency Budget needing to be used.

  4. Hosting fees (if applicable) are paid in advance for 12 months.

  5. Payment terms: 25% invoiced at project commencement, 65% during project lifecycle and balance upon successful completion and sign-off. Alternatively, as negotiated by mutual agreement.

  6. All invoices are due for payment 14 days from date of issue. Where the Customer fails to make full payment by the due date without a valid reason or agreement, Revium may, charge interest at a rate equal to the current ATO benchmark interest rate.

  7. Any additional requests that fall outside of your Proposal or Statement of Work will be charged at Revium's standard hourly rate. Revium will advise in advance if additional fees will be incurred.

  8. Unless it is explicitly stated, content insertion services are not included as part of any projects.

  9. If you authorise Revium to proceed with your project and after commencement it is then put on hold for reasons outside of our control Revium reserves the right to re-quote, or, charge a nominal fee for the additional project management and expenses that stopping and re-starting a project creates.

  10. If Revium is authorised by you to proceed with Development of your project before the Technical and/or functional Specification being formally issued and approved by you (the document(s) to which both parties agree the project is to be developed/implemented), you accept all associated risks and any costs for re-work. Note, this could include re-work and/or changes to project scope. For any such re-work, the costs will be charged on a Time & Materials basis to deliver any additional changes to the scope of work either in the Specifications or actual Development work.

  11. Any third party fees or expenses incurred will be billed to the client at cost.

  12. Standard Rates may be adjusted each year on 1 July and Revium reserves the right to make a CPI increase on an annual basis. Any rate rise would be discussed in advance.

  13. All prices are in Australian dollars and exclude GST. Your quote is valid for 14 days. If the decision to proceed is beyond 14 days of the delivery of your Proposal or Statement of Work, Revium may review the total cost.

  14. If required, any travel, transportation, parking and meal costs are to be passed on to the client at cost. All on-the-road living and accommodation expenses will be at the published ATO relevant daily rate or published ATO motor vehicle allowances for car use

  15. A travel fee applies for any interstate or regional travel outside of the Melbourne metropolitan area to meet the client's requirement. Actual travel time in addition to quoted project fees is charged at a half-time rate for actual time spent traveling per staff member. Precise charge can be confirmed depending on locations required.

  16. To complete the deliverables as outlined Revium will require access to the client’s resources, information and personnel. Any delays in providing access may delay delivery of the project. Revium will advise in advance if any delay may incur additional costs.

  17. Revium will, free of charge, rectify any errors in the agreed deliverables developed by Revium raised during the Warranty Period. Fixes, changes, support or additions of any kind, outside the ‘Warranty Period’ shall be regarded as services to be provided by Revium and will incur additional charges. The Warranty Period is 90 days from the date on which the particular piece of software or change request was released to the production environment or from Acceptance in UAT (whichever occurs first).

  18. Revium reserves the right to display in the public domain (e.g. on our website) that we have performed the services as outlined for the client.  Please advise Revium if you request that this information is not displayed.  No commercially sensitive information will be publicised or if otherwise agreed in any other over-riding contract or agreement.  Revium also reserves the right to display a small, non-intrusive hyperlink to us and our website on any website developed.

  19. The client acknowledges that by engaging Revium resource(s) no direct employment approaches may be made to Revium staff without first consulting a Revium Director.  The client may not directly or indirectly engage a Revium resource for a period of 12 months after an engagement concludes.  The client will pay up to a 20% recruitment fee on any employment by the client of Revium resources not previously agreed to in writing by Revium.

  20. Any work completed on a weekend, public holiday or after standard business hours due to urgent client requests may incur an additional charge at a double time rate.

  21. If applicable, a Revium developed website or web application will be cross-browser compatible for the devices, browsers and operating systems listed below. Our current coverage includes support for all of the significant combinations of browsers and devices. This is based on the two latest mobile devices and the latest desktop browsers that have stable operating system versions. Due to the differences between devices, browsers and operating systems, an identical result is not always possible. Revium will strive to achieve the best result possible but at times there may be slight differences between how pages are rendered by different browsers and/or different devices. It should be noted Revium no longer supports the legacy Microsoft Internet Explorer browser, however, should this be critical to a client project then additional investment options can be presented to accommodate this requirement.

Please contact Revium on any matters concerning the above caveats.
